Wills, Trusts and Estate Planning/Probate

The Law Office of Cindy A. Brand provides affordable estate planning mechanisms to help you plan for your family’s needs. Have you made provisions for your family in the event of your death? Do you have specific goals concerning the distribution of your assets upon death? Regardless of your net worth, everyone needs a valid Will, Durable Power of Attorney, Health Care Directive and possibly a Trust.

A full probate taking one (1) to two (2) years is necessary when an individual dies without the proper estate planning documents and his or her assets exceed $150,000.00. This is true even if a person has a Will, however in most cases, probate is not necessary if a Trust is in place. Because the cost for probating an estate is based on the estate’s gross asset value, probate is necessary if your estate is valued at more than $150,000.00 even though you may have less than that amount in equity in your home. Given the high cost of housing in San Diego County, most people who own a home, or any real estate, fall into the category of needing a Trust.

Trusts allow you to control who gets your assets after you die, however, there are many more reasons for creating a Trust. A Trust can also provide you with more privacy than a Will because you don’t have to file a Trust with the court as in probate. A Trust can also help avoid certain estate taxes if prepared properly. Finally, a Trust allows you to hand over management of your assets to someone else if you are unable to manage your assets yourself.
